Let me introduce myself. My name is Ian Lincoln and I have lived in Spain for over 15 years, as such I am well versed in Spanish bureaucracy.

After having worked in the Norfolk Constabulary for 9 years, diabetes forced me to rethink my goals in life and being fluent in both Spanish and French, I decided to take the plunge and move to Spain.

The idea of sun, sand and cheaper properties drew my family to inland Spain where there were many new off-plan developments. I, like so many, thought the process would be simple and straight forward and I never expected anything else. Sadly, we all know how it turned out.

Maybe I was naïve but I truly believed that the developers would be held responsible, my time in Norfolk taught me that. So, I decided to find a lawyer who would help me recoup my hard-earned money. I spoke to many lawyers who simply told me that the companies had gone bust and it would be an impossible case to win and even if we won, we wouldn’t see a single euro. It would have been a hollow victory, made even more painful by court costs.

One however, Magdalena Rico, told me that the banks were responsible for allowing developers to withdraw money that should have been protected. That sounded a much better idea to me; banks remained solvent whereas developers were allowed to fail. Convinced of her ability to win, I was offered a no win, no fee contract.

The rest, as they say, is history. The Spanish Supreme Court declared in 2015 that the banks were indeed responsible and not only do they have to repay the deposit but they have to pay interest as well.
